1. Operating Hours Daytime Advertising:

Daytime Advertising:

• 7 days a week (Monday to Sunday) – 9:00 AM – 3:00 PM (Hours may vary)
• Unless otherwise specified or prior arranged, extra cost will apply.

Night-time Advertising:

• 3 days a week (Friday, Saturday, Sunday) – 6:00 PM – 9:00 PM
• Unless otherwise specified or prior arranged, extra costs will apply.
  Public holidays will be charged with a 18% surcharge.

2. Campaign & Payment Terms

Minimum Campaign Period: 2 weeks (with the first day provided free of charge).

Payment Method: All payments must be made via direct debit from your nominated bank account prior to campaign commencement.

Ongoing Campaigns: Campaigns automatically renew unless cancelled in writing with at least 7 days’ notice.

Scheduling Adjustments: Campaign dates may be modified due to demand, weather conditions, or other unforeseen circumstances.

Promotional Materials: Clients may supply promotional materials, products, or giveaways for inclusion in their package (by prior arrangement).

Right of Refusal: We reserve the right to reject any materials deemed offensive, inappropriate, misleading, or illegal.

3. Advertising Locations

Advertising will focus on high-traffic areas as agreed upon with the client.
Public events are prioritised to maximise brand exposure.
Services operate within a 15km radius of Broadbeach. Travel beyond this area may incur additional fees.

4. Intellectual Property

All client-provided materials (video, images, text) remain the intellectual property of the client.

Content created by Insta Ads Poolside Two Pty Ltd on behalf of the client is the client’s intellectual property unless otherwise agreed in writing.

Clients grant us permission to use their brand assets for advertising purposes during the campaign only

5. Content Guidelines & Approval

We reserve the right to reject any content that is offensive, misleading, illegal, or inconsistent with our brand values.

All advertising content must be approved by both parties before launch.

Late revisions may incur additional charges and may affect scheduled start dates.

6. Payment Defaults

Services may be paused in the event of failed or missed payments.

All payments must be made upfront before the campaign can commence.

Any default fees will be passed on to client.

7. Liability & Disclaimers

We do not guarantee specific results (e.g., leads, conversions). Our responsibility is limited to delivery of ad impressions.
We are not liable for delays or service interruptions caused by weather, technical faults, or safety issues. Campaigns will resume as soon as conditions allow.

Neither party shall be held liable for non-performance due to unforeseen circumstances (e.g., natural disasters, pandemics, government action).

Clients are fully responsible for ensuring their advertising content complies with all relevant laws and regulations.

8. Reporting & Metrics

Campaign reports are available upon request and may include:

• Areas and locations covered
• Campaign dates and times
• Engagement or impression data (if applicable)
• Reports will be delivered within 7 business days of campaign completion upon request.

9. Cooling Off Period, Cancellation & Refund Policy

Cancellations must be submitted in writing no later than two days after the Client Agreement is signed. A full refund will be issued; however, a non-refundable cancellation fee of $98.00 will apply.

If a campaign is cancelled after it has commenced, a partial refund will be issued, calculated based on the unused portion of the campaign. Charges for services already rendered will be deducted accordingly.

Refunds will only be issued if Insta Ads Poolside Two Pty Ltd is unable to deliver the service and no suitable rescheduling is possible.

10. Client Responsibilities

Clients are responsible for providing accurate and timely information and content.

All materials must be delivered at least five business days before the campaign starts. Delays may impact launch timing.

Any breach of these responsibilities may result in campaign delays or additional fees.

11. Changes to Campaign

Any client-requested campaign changes must be submitted in writing.
Requested changes may require up to three to five business days to implement and may be subject to additional charges.

12. Media Release / Marketing Rights

Insta Ads Poolside Two Pty Ltd reserves the right to showcase campaign visuals (photos, video, testimonials) in our own promotional materials, unless otherwise requested in writing by the client.

13. Indemnity

The client agrees to indemnify and holds Insta Ads Poolside Two Pty Ltd harmless from any claims, damages, or liabilities arising from the content provided or any misuse of the services.

14. Subcontracting

Insta Ads Poolside Two Pty Ltd may subcontract elements of the service to trusted third parties, ensuring the same quality standards are maintained.

15. Non-Exclusivity

This agreement is non-exclusive. We may work with other clients, including those in the same industry, concurrently.

16. Dispute Resolution

In the event of a dispute arising under this agreement, both parties agree to attempt resolution through informal discussion. If unresolved, the matter may be referred to mediation before pursuing legal action.

17. Amendments to Terms

Insta Ads Poolside Two Pty Ltd reserves the right to amend these terms with 14 days written notice.

Continued use of our services after amendments constitutes acceptance of the revised terms.

18. Confidentiality

Both parties agree to keep all non-public information shared during the engagement confidential, unless disclosure is required by law.

19. Agreement Acknowledgement

By engaging our services, the client agrees to these Terms and Conditions in full.

20. Governing Law

These terms are governed by the laws of the State of Queensland, Australia.
